Conclusion of Contract

TRAVEL RoooM is a travel planner/travel agent and arranges tours and services in Tanzania and Zanzibar.

TRAVEL RoooM will be happy to advise you and prepare non-binding travel proposals for you. If you decide on a specific travel proposal, TRAVEL RoooM will ensure that the contract between you and the tour operator is concluded. This gives rise to certain rights and obligations for you and the tour operator with regard to prices, payment conditions, cancellation conditions, liability, complaints and program changes, etc. You will receive the General Terms and Conditions of the tour operator with the travel proposal. TRAVEL RoooM will confirm the trip to you on behalf of the tour operator.

TRAVEL RoooM acts solely as an agent for tours and travel services and is not a party to the tours and other services you have booked.

TRAVEL RoooM would like to point out that all communication with the tour operators in Tanzania is in English (including the General Terms and Conditions etc.).

 

Terms of Payment

The terms of payment for the trip are listed in the General Terms and Conditions of the local tour operator. Payment can be made to the travel agent in Switzerland. The payment must be made to travel agent 14 days before the payment deadlines in the General Terms and Conditions of the tour operator so that the payment can be forwarded to the tour operator’s account in Tanzania or Zanzibar in good time.

 

Cancellation Conditions

In the event of cancellation or no-show, the general terms and conditions of the local tour operator in Tanzania or Zanzibar apply. Cancellation fees are generally charged, regardless of the reason for cancellation. The shorter the cancellation period before the start of the trip, the higher the cancellation fees.

 

Passport, Visa, Vaccinations

The travel agent TRAVEL RoooM will inform you about passport and visa requirements as well as health formalities. It is the traveller's responsibility to obtain a visa in good time.

The tour operator and/or travel agent accepts no liability for refusal of entry due to insufficient or non-existent travel documents such as invalid passports, visas not obtained or not received etc. or necessary vaccinations. You are solely responsible for complying with the prescribed passport, visa, customs, foreign exchange and health regulations.

 

Arrival, Return Journey & International Flights

The traveler is responsible for organizing the arrival and return journey. The traveler is responsible for arriving at the meeting point at the agreed time. If agreed services are not provided due to late arrival at the meeting point, these will neither be made up for nor refunded. If the late arrival leads to additional expenses, these shall be borne by the traveler. Please note that the services are only valid from the start of the travel program in Tanzania. It is therefore your responsibility to arrive in Tanzania on time.

 

Means of Transportation

Every effort will be made by the local tour operator to ensure that all its vehicles are provided in a roadworthy condition, but no liability can be accepted for any puncture, breakdown, damage or delay as a result of poor road conditions.

The airline is liable for domestic flights.

 

Wildlife & Mountain Trekking

It is a privilege to see animals in their natural habitat and therefore the tour operator nor the travel agent cannot guarantee the wildlife or observation of wildlife. You must be careful when observing the animals, keep a minimum distance and carefully follow the instructions of the guide or game ranger.

The instructions of the mountain guide should also be followed during a mountain ascent or hike.

 

Risks

The traveler accepts that all tours are adventurous in nature and involve personal risk.

The operator and/or the agent accept no responsibility for any illness, injury, death, loss or damage of any kind to persons or property arising as a direct or indirect result of any accident arising out of any aspect of your travel whilst using the services of the operator’s fleets, except to the extent that such accident was caused beyond all reasonable doubt by an intentional or grossly negligent act of the operator’s personnel, in which case the local tour operator shall be liable.

It is therefore mandatory to take out comprehensive travel insurance.

 

Liability

The tour operator will do its best to ensure that all tours, activities and services are properly arranged and operated as advertised. Although only working with suppliers (e.g. hotels, lodges, flights etc.) that have a good reputation, the tour operator and/or the agent have no direct control over the services they provide and therefore cannot be held responsible for any errors made by these suppliers.

 

Force Majeure

Should the tour operator be affected by force majeure, i.e. circumstances beyond the company’s control (including but not limited to explosions, floods, storms, fires, accidents, war or threat of war, sabotage, riots, civil commotion or requisition, disease, quarantine, government intervention, weather conditions or other external events), you will be informed immediately of the nature and extent of such circumstances. The company is not permitted to violate or abuse these conditions.

The operator and/or the agent accept no liability for unforeseen circumstances beyond their control.
