1. WHAT THESE GENERAL TERMS AND CONDITIONS OF CONTRACT AND TRAVEL REGULATE
1.1 Scope of application
These General Terms and Conditions of Contract and Travel govern the legal relationship between you and TRAVEL RoooM by Romina Casutt (TRAVEL RoooM) for tours organised by TRAVEL RoooM in its own name.
1.2 Local services, third-party services
These contract and travel conditions do not apply to services that you book locally with third-party companies (third-party services). In this case, you conclude the contract directly with the local company.
The General Terms and Conditions of Contract and Transport of the responsible airlines apply to all flight tickets for local flights arranged by TRAVEL RoooM. TRAVEL RoooM is not a party to the contract in these cases and you can therefore not refer to these General Terms and Conditions of Contract and Travel.
1.3 Arrival and return journey
TRAVEL RoooM only offers land services. Should TRAVEL RoooM assist you in organising your travel to and from Tanzania or Zanzibar, this is purely for assistance. You will make the relevant international (flight) bookings yourself and on your own responsibility. TRAVEL RoooM is not a party to the contract of carriage and is not responsible for its fulfilment. When travelling to Tanzania and Zanzibar, TRAVEL RoooM recommends allowing sufficient time between arrival in Tanzania and Zanzibar and the start of the TRAVEL RoooM arrangement so that the booked programme can still start as planned if there is a delay in arrival. This also applies to the delayed arrival of flight baggage.
1.4 Your booking office arranges other services
If your booking office arranges travel arrangements or individual services for you from other tour operators or service providers, you conclude the contract with these companies and their contractual conditions apply. In these cases, TRAVEL RoooM is not your contracting party and is not responsible for the fulfilment of these contracts.
2. REGISTRATION / HOW THE CONTRACT BETWEEN YOU AND TRAVEL RoooM IS CONCLUDED
2.1 Websites, travel proposals
The TRAVEL RoooM websites and other advertising material as well as travel proposals are not binding offers. These details are for information purposes only and are subject to change at any time. The same applies to any price information.
2.2 Conclusion of contract
TRAVEL RoooM’s travel proposals are non-binding. By paying the deposit (section 4.2 f.) you submit a binding offer to TRAVEL RoooM to conclude the travel contract. You are bound by this offer for 10 days. TRAVEL RoooM will send you the travel confirmation within this period or inform you that the programme can only be carried out with changes or has to be cancelled. TRAVEL RoooM reserves the right to make minor changes to the travel proposal which do not prevent the conclusion of the contract (e.g. equivalent alternative accommodation). From the time of the travel confirmation, the rights and obligations arising from the contract with these General Terms and Conditions and the travel information sent to you become effective for you and TRAVEL RoooM. If the trip cannot be carried out, the deposit will be refunded.
If you register further travellers, you are responsible for their contractual obligations (in particular payment of the tour price) as you are for your own obligations.
The contractual agreements, these General Terms and Conditions of Contract and Travel, the travel information and data protection provisions apply to all travellers.
TRAVEL RoooM may reject registrations without giving reasons.
2.3 Group tours and minimum number of participants
There is a minimum number of participants for TRAVEL RoooM group tours, which may vary. This is stated in the tour description. If fewer than the minimum number of participants take part in a tour, TRAVEL RoooM may cancel the tour no later than 3 weeks before the scheduled departure date. In this case, TRAVEL RoooM will endeavour to offer you an equivalent replacement programme. If you cancel the replacement programme, TRAVEL RoooM will refund any payments already made. Insurance premiums cannot be refunded. Further claims for compensation are excluded.
2.4 Names
It is important that you enter the names and dates of birth of all travellers correctly when registering, i.e. as they are written in the passport used for the trip. This is necessary so that the travel documents can be issued correctly. If the details are missing or incorrect, this can lead to major difficulties, such as refusal of entry or service providers refusing to provide their services. You are responsible for ensuring that your name and date of birth are correct.
2.5 Passport, visa, vaccinations
On the travel proposal or in the travel information and confirmation from TRAVEL RoooM you will find general information regarding passport and visa requirements as well as any health regulations that you must fulfil when entering Tanzania and Zanzibar. However, it is in your own interest to enquire at the time of booking whether and which regulations apply to your trip, as these regulations may change at short notice. You are responsible for complying with passport, visa, insurance and immunisation requirements and for carrying your own travel documents. Any disadvantages arising from non-compliance with these regulations will be borne by you.
3 SERVICES
3.1 Services provided by TRAVEL RoooM
The services provided by TRAVEL RoooM are set out in the travel proposal and the travel confirmation. Special requests on your part or additional agreements are only part of the contract if they have been expressly confirmed by TRAVEL RoooM.
Only the travel proposal and confirmation from TRAVEL RoooM are authoritative. If you have obtained information on the Internet, forums or received brochures etc. from third parties, this information is not binding on TRAVEL RoooM.
TRAVEL RoooM would like to point out that the travel programme for safaris, ascents of Mount Kilimanjaro or Mount Meru, excursions and outdoor activities of all kinds are subject to change at any time in order to provide you with the best possible experience. This may be the case in particular due to game populations, weather conditions, official directives and so on. Such changes are part of the trip and do not give rise to a free cancellation of the trip or a price reduction.
TRAVEL RoooM will inform you of the operating airline as soon as this has been determined and the flight is part of your TRAVEL RoooM travel programme.
3.2 Start of services
TRAVEL RoooM only offers land services in Tanzania and Zanzibar. Travelling to the destination is not part of TRAVEL RoooM’s travel services.
You are responsible for travelling to and arriving at the agreed meeting point on time. In the event of late arrival, it is possible that part of the travel programme can no longer be carried out. In this case, no refund of the corresponding part of the travel programme can be made.
3.3 Conditions of participation
On accompanied tours, the instructions and directions of the guides must be strictly followed. In lodges, guest houses, camps, tents and other accommodation, the house rules and behavioural instructions must be followed; the same applies to official orders and instructions. This is for your own safety.
For mountain climbs such as Mount Kilimanjaro or Mount Meru, good health, appropriate fitness and (mountain) equipment are required.
If you are travelling to high altitudes (over 2,300 metres above sea level), seek advice from a doctor with experience in altitude medicine before making a definitive booking, as there is a risk of altitude sickness.
TRAVEL RoooM draws your attention to the fact that mountain rescues are hardly possible in Africa. See the information on travel insurance.
4. PRICES, PAYMENT TERMS AND TRAVEL DOCUMENTS
4.1 Prices
TRAVEL RoooM will inform you individually of the binding price. The prices are per person in a double room. The prices are in US Dollars. On request, the invoice can be issued in Swiss francs. The invoice amount in Swiss francs is calculated on the basis of the current daily exchange rate, plus a transaction fee of 4% to cover exchange rate fluctuations and processing fees. Example: For an invoice amount of USD 1,000 and an exchange rate of USD 1 = CHF 0.9162, the final amount is CHF 952.85.
The prices are to be understood as cash prices; a surcharge will be charged for credit card payments.
Any bank and transaction fees shall be borne by you.
For price changes after conclusion of the contract, see section 6.
4.2 Payment
If you wish to book a trip, a deposit of 40% of the total amount must be paid. The balance of 60% of the total amount is due no later than 30 days before the trip. If the balance is due at an earlier date, you will be informed of this in the travel proposal or upon confirmation.
If the balance is not paid on time, TRAVEL RoooM is entitled to refuse the travel services after a short grace period has expired without success. In this case, the trip will be considered cancelled and the cancellation costs in accordance with section 5 will be due for payment.
4.3 Last-minute bookings
If you book your trip less than 31 days before departure, it may be necessary to make enquiries at hotels, etc.; any communication costs will be charged to you.
For bookings made at short notice, the full invoice amount must be paid when booking (see section 2.1).
4.4 Cost shares of your booking office for advice and reservations
We would like to draw your attention to the fact that your booking office may charge additional costs for advice, reservations and processing in addition to the prices mentioned in the brochure/advertisement. Your booking centre will inform you accordingly.
4.5 Travel documents
Unless otherwise agreed, the travel documents will be issued or sent to you after receipt of your payment for the full invoice amount.
If you do not receive the travel documents within this period, please inform your booking office immediately.
5. YOU CHANGE YOUR REGISTRATION, YOUR TRAVEL PROGRAMME OR ARE UNABLE TO TRAVEL (CANCELLATION)
5.1 General information
In the event of a cancellation, change or rebooking of your trip or change of name, we will charge a processing fee of CHF 100 per person.
If you wish to make a change, rebook the trip or change your name or cancel the trip, you must notify TRAVEL RoooM or your booking office in writing by e-mail or registered letter. Any travel documents already received must be returned at the same time.
Insurance premiums, visa costs and processing fees will not be refunded in the event of cancellation.
5.2 Flights Tanzania and Zanzibar
The airline’s cancellation or change policy applies. Flights are sometimes subject to very strict cancellation and rebooking conditions. These are usually 100%. Taxes and surcharges are non-refundable with some airlines or fares.
5.3 Cancellation costs
5.3.1 In the event of changes (including name changes), rebookings or cancellations, the following cancellation fees will be charged in addition to the processing fees (Section 5.1):
From the date of the travel confirmation up to 90 days before the start of the trip:
25% of the travel price
89 – 60 days before departure: 50 % of the tour price 50 % des Reisepreises
59 - 30 days before the start of the tour: 75 % of the tour price
29 - 0 days, no-show: 100 % of the tour price
5.3.2 Deviating cancellation costs can be found in the travel proposal or on the travel confirmation.
5.3.3 Your booking office is authorised to charge additional cost shares for its expenses.
5.3.4 If new entry or health regulations are introduced after conclusion of the contract, e.g. vaccinations or medical tests (e.g. PCR test) etc., these must be complied with. If you are unable or unwilling to comply with these conditions and cancel the trip, the normal cancellation conditions apply.
5.3.5 The date of receipt of your written declaration by TRAVEL RoooM during normal office hours from Monday to Friday is decisive for calculating the cancellation and amendment date; on Saturdays, Sundays and public holidays, the next working day is decisive. This regulation also applies to notifications by e-mail, via our website, telephone answering machine, fax or other electronic media.
5.4 Cancellation insurance
5.4.1 We recommend that you take out cancellation insurance. This pays the cancellation costs in the event of an insured event. The applicable insurance policy is authoritative.
5.4.2 If you cancel the trip, the premium for the cancellation insurance remains due and will not be refunded.
Even if you have taken out cancellation insurance, you remain the debtor of the cancellation costs.
6. CHANGES TO BROCHURE DESCRIPTIONS, PRICE CHANGES, PROGRAMME CHANGES, CHANGES IN THE TRANSPORT SECTOR
6.1 Changes before conclusion of the contract
TRAVEL RoooM expressly reserves the right to change service descriptions, descriptions on websites etc. as well as prices before your booking.
6.2 Price changes after conclusion of the contract
6.2.1 Price increases after conclusion of the contract may result from
a. subsequent increases in transport costs (including fuel surcharges);
b. newly introduced or increased charges or fees (such as airport taxes, landing fees, embarkation and disembarkation fees, security fees, the introduction or increase of taxes and government levies, government-imposed price increases, national park fees, etc.), or
c. Changes in exchange rates
d. Errors on the confirmation.
If the costs of these travel services increase, these may be passed on to you. The tour price will increase accordingly.
6.2.2 We will inform you of a price increase no later than 3 weeks before the start of the trip. If the price increase is more than 10 per cent (in relation to the total price of the trip per person), you are entitled to the rights set out in section 6.4.
Errors in the confirmation can be corrected at any time and regardless of their amount. Clause 6.4 does not apply.
6.3 Programme changes, changes in the transport sector after your booking and before the start of the trip
TRAVEL RoooM reserves the right, also in your interest, to change the travel programme or individual agreed services (such as accommodation, mode of transport, means of transport, etc.) if force majeure, unforeseeable or unavoidable circumstances, natural events, official measures, strikes, etc. or dispositions of service providers such as airlines make this necessary. TRAVEL RoooM will endeavour to offer you equivalent replacement services.
TRAVEL RoooM will inform you as soon as possible about such changes and their impact on the price.
You are not entitled to the following rights (clause 6.4) for safaris, outdoor activities of all kinds, mountain climbs, etc. if the changes are made due to weather conditions, animal populations, animal migration, official orders, etc. Such changes include safaris, mountain climbs, etc. and are not included in the price. Such changes are inherent to safaris, mountain climbs, outdoor activities etc. and are the correct fulfilment of the contract.
6.4 Your rights if the tour price is increased or changes are made to the programme or transport after the contract has been concluded
6.4.1 If the change to the programme or the change to individual agreed services leads to a significant change to an essential point of the contract or if the price increase is more than 10 percent of the total price of the trip per person, you have the following rights:
a. You can accept the change to the contract;
b. You may cancel the contract in writing within 5 days of receipt of our notification and you will be refunded the price already paid without delay;
c. or you can inform us in writing within 5 days of receipt of our notification that you wish to take part in an equivalent alternative tour proposed by us. We will endeavour to offer you such a trip. If the alternative trip is cheaper, the difference in price will be refunded to you. If the alternative trip is more expensive, the originally agreed price must be paid.
6.4.2 If you do not send TRAVEL RoooM a notification in accordance with letters b. or c., you agree to the price increase, the programme change or the change to individual agreed services. The 5-day deadline is met if you send your notification by e-mail on the last day of the deadline during office hours.
7. Cancellation of the trip by TRAVEL RoooM
7.1 Cancellation for reasons for which you are responsible
TRAVEL RoooM is entitled to cancel your trip if you give justified cause for this through actions or omissions. The cancellation costs in accordance with section 5 remain due and the right to claim damages is reserved.
7.2 Unforeseeable events, force majeure, strikes
7.2.1 If unforeseeable or unavoidable events, force majeure (e.g. natural disasters, epidemics, unrest), natural events, political circumstances, official measures of any kind or strikes make the trip considerably more difficult, endanger it or make it impossible, TRAVEL RoooM may cancel the trip. In this case, TRAVEL RoooM will refund the travel price paid. (Insurance premiums will not be refunded or remain due). Further claims on your part are excluded.
7.2.2 When deciding whether a trip can be carried out or not, we consult the recommendations of the Federal Department of Foreign Affairs (FDFA), the Federal Office of Public Health (FOPH), the relevant authorities in the countries travelled to and information from our local service providers and check whether there is a specific risk to the trip or the participants. In the event of a concrete existing risk or a possible future concrete risk, we reserve the right to cancel the trip.
8 Programme changes, cancellation of services during the trip
8.1 Programme changes during the trip are possible in order to offer you the best possible travel experience. Such changes may occur due to weather conditions, animal populations and migrations, official directives, etc., particularly in the case of mountain tours, safaris and other outdoor activities. Such changes are part of the travel contract and do not constitute a travel defect. TRAVEL RoooM will endeavour to offer appropriate compensation in such cases. Further claims are excluded.
Should changes to the programme and services be necessary due to other circumstances, TRAVEL RoooM will offer an equivalent solution as far as possible. Should the remedy cause excessive costs or disproportionate effort for TRAVEL RoooM, TRAVEL RoooM may refuse the remedy. Any additional costs shall be borne by the traveller.
8.2 If programme and service changes or service cancellations are caused by force majeure, TRAVEL RoooM may refuse to remedy the situation. Possible additional costs shall be borne by the traveller.
8.3 If the change in services or program affects a significant part of the agreed-upon trip, TRAVEL RoooM will compensate you for any objective reduction in value between the agreed travel price and the price of the services actually provided (see section 11). Excluded from this are changes according to section 8.1, paragraph 1.
9. YOU COMMENCE THE TRIP, BUT CANNOT COMPLETE IT, UNUTILIZED SERVICES
9.1 If you cancel the trip early or do not utilize certain services, the price for the travel arrangement or the unutilized services cannot be refunded.
9.2 In urgent cases (e.g., personal illness or accident, serious illness or death of a close relative), TRAVEL RoooM or the local organizer will assist you as much as possible. – TRAVEL RoooM explicitly points out that, in some cases, an early return may not be possible or could incur very high costs.
9.3 Any costs, such as for transport, etc., will be at your expense. In this context, please also consider the option of purchasing a so-called return travel insurance, which is not included in the travel price.
10. IF YOU HAVE A COMPLAINT
10.1 Complaint Deadline and Request for Remedy
If the trip does not meet the contractual agreement or you suffer damage, you are required to immediately report the defect or damage to the guide for accompanied trips or to TRAVEL RoooM for unaccompanied trips and request free remedy.
10.2 The guide or TRAVEL RoooM will make every effort to provide a remedy within a reasonable time frame during the trip. If no remedy is provided within the reasonable time frame of the trip, or if the remedy is insufficient or not possible, you should have the complained defects or damage and the lack of remedy documented in writing by the service provider. They are not authorized to acknowledge any claims for compensation or similar.
10.3 Depending on the travel destination, a different procedure for handling defects and damages may be established.
10.4 Self-Remedy
If no remedy is provided within a reasonable time frame during the trip and it concerns a significant defect, you are entitled to take corrective action yourself. The costs you incur will be reimbursed within the framework of the originally agreed trip (hotel category, means of transport, etc.) and upon presentation of receipts, provided that you have reported the defect and requested written confirmation (Sections 10.1 to 10.3; further details under Section 11).
10.5 How to Assert Your Claim Against TRAVEL RoooM
If you wish to assert claims for defects, refunds, compensation, etc., against TRAVEL RoooM, you must submit your claim in writing to TRAVEL RoooM within 30 days after the contractual end of the trip. Your claim must include the guide’s or service provider’s confirmation and any relevant evidence.
10.6 Forfeiture of Your Claims
If you do not report the defects or damage, etc., in accordance with Sections 10.1 to 10.3, you lose and forfeit all rights, such as the right to remedy, self-remedy, reduction of the travel price, termination of the contract, compensation, etc. The same applies if you do not assert your claim in writing within 30 days after the contractual end of the trip. The provisions regarding flight baggage (Section 10.8) remain reserved.
10.7 Flights to Tanzania and Zanzibar
Special conditions apply to flights. If your flight baggage does not arrive, is damaged, or is destroyed, you must report this damage to the airline immediately upon arrival in writing, preferably at the airport, otherwise, you will lose your rights. Furthermore, the transport conditions of the airlines are binding.
11. LIABILITY OF TRAVEL RoooM
11.1 General
TRAVEL RoooM will reimburse you, in accordance with these General Terms and Conditions of Travel, the value of agreed-upon services that were not provided or were poorly provided, as well as any additional expenses or damages suffered, to the extent that the local representative, service provider, or TRAVEL RoooM was unable to offer an equivalent replacement service on-site.
In the case of self-remedy (Section 10.4), your additional expenses will be reimbursed up to a maximum of twice the travel price per person for each traveler. Sections 8.1 and following provisions remain reserved.
11.2 Limitation of Liability, Exclusions of Liability
11.2.1 International Agreements and National Laws
If international agreements, laws based on international agreements, or national laws contain limitations or exclusions of compensation for damages, etc., due to non-fulfillment or improper contract fulfillment, TRAVEL RoooM is only liable within the framework of these agreements and laws.
International agreements, laws based on international agreements, and national laws with limitations and exclusions of liability particularly apply to transportation.
11.2.2 Exclusion of Liability
TRAVEL RoooM is not liable to you if the non-fulfillment or improper fulfillment of the contract is due to the following causes:
a. Your own omissions before or during the trip (e.g., missing or inadequate equipment, lack of fitness and health, failure to follow instructions, house rules, official orders, etc.);
b. Unforeseeable or unavoidable omissions by a third party who is not involved in providing the contractually agreed services;
c. Force majeure or an event that TRAVEL RoooM, the local organizer, representatives, the guide, or the service provider could not foresee or prevent despite due care.
In these cases, any liability for damages, compensation for non-material damages, frustration damages, compensation for self-remedy, etc., is excluded for TRAVEL RoooM.
11.2.3 Personal Injury
For personal injuries resulting from non-fulfillment or improper fulfillment of the contract, TRAVEL RoooM is liable within the framework of these General Terms and Conditions of Travel, the applicable international agreements, laws based on international agreements, and national laws.
11.2.4 Other Damages (Property and Financial Losses, etc.)
For other damages, i.e., not personal injuries, arising from non-fulfillment or improper fulfillment of the contract, TRAVEL RoooM’s liability is limited to a maximum of twice the travel price per person for each traveler, unless the damage was caused intentionally or through gross negligence. These General Terms and Conditions of Travel, as well as applicable international agreements, laws based on international agreements, and national laws with lower liability limits or exclusions of liability, remain reserved.
11.2.5 Wasted Vacation Time, Lost Vacation Enjoyment, Frustration Damages
TRAVEL RoooM is not liable for wasted vacation time, lost vacation enjoyment, frustration damages, etc.
11.2.6 Valuables, Cash, Jewelry, Credit Cards, Photo/Video Equipment, Electronic Devices, etc.
TRAVEL RoooM explicitly informs you that you are responsible for the safe storage of valuables, cash, jewelry, credit cards, photo and video equipment, electronic devices, etc.
You must not leave these items unattended in an unsupervised vehicle or anywhere else.
TRAVEL RoooM is not liable for theft, loss, damage, or misuse of lost valuables, photo and video equipment, cash, jewelry, credit cards, electronic devices, etc.
11.3 Events During the Trip
Outside of the agreed-upon travel program, local events or excursions may be booked during the trip. It is possible that such events and excursions are associated with risks. It is your own responsibility whether or not you participate in these events and excursions. These events and excursions are organized by third-party companies (external services). TRAVEL RoooM is not your contracting party and is not liable in any case. These are considered external services, even if you book them with a guide on-site or if a guide participates in them.
11.4 Non-Contractual and Quasi-Contractual Liability
Non-contractual and quasi-contractual liability is governed by the relevant legal provisions and international agreements. Non-contractual and quasi-contractual liability cannot establish liability beyond the scope of contractual liability.
In the case of other damages (i.e., not personal injuries), liability is, in any case, limited to twice the travel price per person for each traveler, unless international agreements, laws based on international agreements, national laws, or these General Terms and Conditions of Travel provide lower liability limits or exclusions of liability.
11.5 Limitation Period
All claims expire one year after the contractual end of the trip. Shorter limitation periods in applicable international agreements, laws based on international agreements, or national laws, or longer, contractually non-modifiable limitation periods, remain reserved.
12. RETURN TRIP
If you are planning your return trip to Switzerland, please consider the possibility of a delayed end to your trip in Tanzania or Zanzibar and allow enough time between the planned end of the trip and check-in, as well as for check-in and departure formalities, etc.
13. INSURANCES
TRAVEL RoooM recommends that you review your insurance coverage. In particular, ensure you have adequate health and accident insurance for Africa, as well as additional return travel insurance. If you plan to climb Mount Kilimanjaro or Mount Meru, your insurance should also include helicopter rescue, if necessary. TRAVEL RoooM points out that rescue, doctor, hospital costs, etc., in Tanzania and Zanzibar can be very high (and the medical standard may not meet European standards).
Important for Zanzibar: Starting October 1, 2024, all foreigners entering Zanzibar by sea or air are required to have a valid inbound travel insurance policy from Zanzibar Insurance Corporation, which covers the duration of their stay (up to 92 days).

Although such insurance is mandatory, you should still check your private insurance coverage (accident, illness, etc.).
14. ENTRY REQUIREMENTS, VISA AND HEALTH REGULATIONS, LUGGAGE REGULATIONS
14.1 Entry Requirements and Plastic Bags
The travel proposal and travel information contain details about passport and entry regulations. These details apply to Swiss citizens, citizens of Liechtenstein, and the EU. Citizens of other countries should provide their nationality when booking so that the booking office can inform them of the relevant regulations.
TRAVEL RoooM or your booking office assumes that there are no special circumstances such as dual nationality, statelessness, etc.
A valid passport with at least two empty opposite pages is required, which must be valid for at least 6 months after the stay. The mandatory visa can be applied for electronically in advance or obtained upon arrival at the airport. Details are provided in the travel information, which you will receive with the non-binding travel proposal.
These details apply only if you are traveling directly by air from Switzerland or an EU state. If your trip involves a stopover in another country or if you are traveling overland, different entry and health regulations may apply, which you will need to check on your own.
TRAVEL RoooM expressly advises you that plastic bags (e.g., plastic shopping bags, plastic bags for cosmetics, etc.) are prohibited when entering Tanzania and Zanzibar. The importation of plastic bags is a criminal offense and may be punishable by a fine or imprisonment.
14.2 Visas and Travel Documents
If travel documents need to be issued or extended, visas obtained, etc., you are responsible for this yourself.
Visa applications, etc., must always be completed in full. The first and last names should be provided exactly as they appear in the passport being used.
14.3 Compliance with Entry Requirements
You are responsible for complying with the entry, passport, visa, customs, health, and currency regulations in any transit and destination country. Before departure, make sure you have all the necessary documents with you. If a travel document is not available or is issued too late, and you need to cancel or modify your trip, the cancellation policies will apply.
14.4 Refusal of Entry
TRAVEL RoooM advises you that in the event of a refusal of entry, you will be responsible for covering the return travel costs.
14.5 Baggage
If you have booked a domestic flight or a flight from Tanzania to Zanzibar through TRAVEL RoooM, you will receive the baggage details with your travel documents. Baggage allowance is limited.

16. OMBUDSMAN
16.1 16.1 Before pursuing legal action, you should contact the independent Ombudsman of the Swiss travel industry. The Ombudsman seeks to reach a fair and balanced resolution for any issues between you and TRAVEL RoooM or the booking office where you made your reservation.

17. DATA PROTECTION
17.1 Your Data
Your booking office and we require various details from you and your fellow travelers (such as first and last name, date of birth, address, phone number, booked travel services and dates, possibly passport details and payment information, etc.) for the proper processing of the contract. Your Swiss booking office and we are subject to Swiss data protection law. We are obligated to store your data securely and will store it in Switzerland.
17.2 Transmission to Service Providers and Authorities
We will forward your data, as necessary for contract processing, to the service providers. These may be located abroad (especially Tanzania and Zanzibar), where data protection may not meet Swiss standards. The service providers process your data independently and in accordance with the regulations applicable to them.
Both we and the service providers may be required by law or by government order to forward your data to (foreign) authorities or private entities designated by authorities.
These provisions apply to data transfers worldwide.
17.3 Special Categories of Personal Data
You may provide us with information regarding dietary preferences, allergies, health conditions, or assistance needs, among others. Such information may be considered sensitive personal data. For example, a dietary preference may imply your belief system, or an assistance need may reveal information about your health. These data are typically forwarded to service providers for the proper fulfillment of the contract or may, in certain cases, be disclosed to government authorities or third parties designated by authorities due to legal obligations or government orders. By providing us with such information, you explicitly authorize us to use it according to this provision, the data protection regulations, and the contract and travel conditions.
This provision applies to global data transfers.

We may contact you in the future to inform you about our programs and travel offers. You can unsubscribe from this service at any time by emailing info@travel-rooom.ch.
17.5 Enforcement of Rights
TRAVEL RoooM reserves the right to forward your data to authorities and third parties for the enforcement of legitimate interests. The same applies in case of suspected criminal activity.

18. APPLICABLE LAW AND JURISDICTION
18.1 All legal relationships between you and TRAVEL RoooM are governed by Swiss law. Chur is agreed as the exclusive place of jurisdiction.
18.2 The invalidity of individual provisions of the travel contract does not affect the validity of the entire contract.
18.3 The above provisions regarding the choice of law and jurisdiction are subject to any non-modifiable contractual provisions in applicable laws or international agreements.
